Monday 30 November 2015

The Chief Justice of Nigeria (CJN) Justice Mahmud Mohammed, yesterday, decried what he termed “lack of political will to prosecute high-profile corruption cases” by the executive.
In what seem like a reaction to an earlier statement by President Muhammadu Buhari, the CJN made his position known during a meeting with the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami (SAN), in his conference room. He said the lacklustre attitude of  government towards the prosecution of criminal cases, “especially those involving politically exposed persons or political party family members,” was a major factor that has stalled trial of so many corruption cases.

A statement issued by media aide to the CJN, Mr. Ahuraka Isah, revealed that the meeting took place on November 24. Among those in attendance included Supreme Court Justices as well as heads of other federal courts.
President Muhammadu Buhari had while flagging-off the 2015 All Nigeria Judges’ Conference, slammed the judiciary, accusing it of sabotaging his effort to prosecute high-profile corruption cases.
Buhari, who was represented at the event by Vice President Yemi Osinbajo, lamented  that “allegations of judicial corruption have become  more strident and frequent,” noting: “There is both local and international dissatisfaction with the long delays in the trial process. In the past few years, this has become especially so for high-profile cases of corruption, especially where they involve serving or former political office holders.”
The CJN, however, said: “Experience within the Judiciary shows that there is abject lack of political will to prosecute some of those cases pending before our various courts almost a decade in some instances.
“It is not because there are no special courts, but mostly for reasons of political expedience and other ancillary considerations.
“I would likewise wish to encourage you (AGF) to display a greater resolve than your predecessors in tackling outstanding cases before the courts. In times past, the Attorney General of the Federation would often lead teams of legal counsel in high profile cases so as to demonstrate the resolve of the government to enshrine the rule of law.
“Sadly, recent Attorneys-General have become less inclined to do this. I would certainly like to see you, as the Attorney General, appear before us especially in cases of important national purport.
“There is the need for seasoned prosecutors to prepare and file charges before courts of competent jurisdiction so that criminal matters are timeously determined.
“The quality of prosecutions presented in courts by our prosecutorial agencies must be improved upon, as they are sometimes of a standard that will never found a conviction in any court anywhere, yet, a well prepared prosecution can see to the determination of criminal matter within a month.
“Of course, no competent prosecutor who has filed valid charges would permit an accused to mount an interlocutory appeal, to the extent of going forth and back, sometimes twice or more to the Supreme Court, since such lapses could be injurious to the dispensation of justice.”
The CJN also advised the AGF to recruit more lawyers who should be adequately trained to handle more cases on behalf of the State, saying it would create a reservoir of highly trained, public spirited lawyers to feed the Bench and the Bar.

26-year-old musician, Waidi Kabiru, was on Sunday, November 23, reportedly abducted from Igbogbo Police Station, Lagos State, by a three-man gang.
PUNCH Metro gathered that the three man gang wore reportedly masks, sneaked into the station around 1am on Sunday and bundled him out of the cell.
The state police command confirmed that Waidi, was arrested on Friday, November 21. but said he had been released on bail. The command, however, did not disclose the surety to whom the youth was released.
Waidi’s father, Mr. Bisiriyu Kabiru, said he had been visiting his son since he was arrested on Friday but that he had gone to the station to give him food on Sunday only to be told that he was no longer inside the cell.
He said:
“He called me on the phone around 9am on Friday that he was arrested during a raid and I went to the station to see him. One of the policemen I met asked me how much I had to bail him out and I said N4,000. But he told me it wasn’t enough and I left. I later came back with N5,000, but I was told that the DPO had taken over the case.
“On Saturday, I brought food for him (Waidi) at the station and was there till the evening, trying to secure his bail. When I got there on Sunday to give him food, the policemen at the counter said he had gone out with the DPO. But I was not allowed to see the DPO. I later learnt that he was whisked out of the cell early Sunday morning by three men who were masked. It was on Monday that I decided to inform his mother.”
Waidi’s mother, Karimat Adebanbi, said she went to the station on Monday and was shown a register containing details of suspects.
According to her:
“The policemen I met at the station called my son from the cell, but nobody answered. They checked the register and saw his name there, indicating that he had been released on bail. I asked them who stood as a surety for him, but they refused to tell me. They told me to look for him at his friends’ houses. We don’t know his whereabouts and his number is switched off.
“I went to the station again on Thursday and Saturday to see the DPO; they said he was not around. I called him several times before he picked his call. He said he was somewhere and told me to wait. I waited for hours but he did not come back.”
The family had also petitioned the state Commissioner of Police, Fatai Owoseni, through an activist, Prince Akinsemoyin, to investigate Waidi’s disappearance from the cell.
The petition also requested the CP to interrogate the DPO and policemen involved in the case to unrasvel the circumstances surrounding the youth’s disappearance.
It read in part:
“I wish to bring to your attention that up till now, the whereabouts of Waidi Kabiru is still unknown. We strongly suspect a foul play in this matter. The time has come to critically investigate the DPO and the role the DPO played in this case. If he has been released, to whom? On what grounds was he released to the surety and what offence was he arrested for?
“We would like the police to produce the surety or else the policemen involved in this matter need to explain his sudden disappearance from Igbogbo police’s custody. This incident is capable of bringing the image of the police to disrepute. We hereby request a full scale investigation into this matter.”
The Lagos State police spokesperson, DSP Joe Offor, said Waidi was not abducted from the cell, insisting that he had been released on bail. He, however, said he did not have the knowledge of the name of the surety.
He said:
“It was not true that he was abducted. The suspect was released on bail to an unidentifiable person. The DPO said he had the name of the surety, but he did not disclose the name of the person to me.”

About 20 top officials of the previous administration, who were alleged to have played active roles in the disappearance of $2 billion meant for the procurement of arms and ammunition for the country’s armed forces were taken into custody by the Economic and Finance Crimes Commission, EFCC, for questioning.
Some of the officials taken into custody are the former Minister of State for Finance, Ambassador Bashir Yuguda and a former Director of Finance in the Office of the National Security Adviser, Shuaibu Salisu.
The former minister, who worked under Dr. Ngozi Okonjo-Iweala, was still being questioned by operatives of the EFCC in Abuja as at last night.
Shuaibu Salisu was said to have been arrested and detained for a while over various payments that he allegedly made.
A source in the EFCC confirmed that the sons of many top-ranking PDP officials were also found to have received various sums of money under the guise of supplying weapons for the armed forces but did not deliver.

A group of illegal immigrants is suing the state of Oregon to overturn a voter-approved initiative that denied them driver’s licenses.
The lawsuit, brought by five illegal immigrants, comes after Oregonians passed Measure 88 last year with a strong two-thirds majority. Thirty-five of Oregon’s 36 counties voted against licenses for illegal immigrants as did every congressional district in the state, most of which are represented by Democrats.
But the lawsuit alleges Measure 88 is unconstitutional because it "arbitrarily" denies driving privileges based on membership in a "disfavored minority group." It alleges Oregon voters were motivated by "animus toward persons from Mexico and Central America."
Gustavo Recarde, who has worked construction and odd jobs in Portland and several states since sneaking into the United States in 1988, said a driver's license would help him feel more comfortable here and open doors.
"If an illegal [can] get a driver's license, it would be better because there's more opportunities to find a job as a driver," said Recarde, who is not part of the lawsuit. He said he believes race played a role in the vote.

But Cynthia Kendoll, president of Oregonians for Immigration Reform, said it's not the responsibility of Oregonians to make illegal immigrants comfortable or able to drive to jobs they don't legally have.
"They came here by choice, they weren't brought here against their will, and with those choices come hardships," she said.
Measure 88 was a public vote that prevents giving "driver's cards" to those who cannot prove they are in the U.S. legally.
The campaign to deny licenses won big despite being outspent 10-to-one.
"People were not swayed by their arguments that they deserve to have a driver's card so they could more easily get to their jobs," Kendoll said. "They're not supposed to be working here."
Kendoll said Oregonians were motivated by national security and drug-smuggling by Mexican cartels, not race. Those without papers have not gone through immigration checks, she said, and licenses make it easier to transport narcotics up and down the West Coast.
Norman Williams, associate dean for academic affairs at the Willamette University College of Law in Salem, said:
"The U.S. Supreme Court has been clear that neither legislators nor voters may target a minority group because of their race or ethnicity," he said.
The plaintiffs -- five illegal immigrants identified only by their initials -- don't have to prove every Oregon voter was racially motivated, he said.
"They do have to establish there were enough voters who voted 'no' who were prompted to do so because of racial concerns, that could have tipped the balance," he said.
Still, Williams said they face an uphill battle.
"Federal judges are very hesitant to strike down state statutes on constitutional grounds," he said.

Documents filed in federal court in North Carolina say an American Airlines flight attendant who described herself as "crazy" and a "train wreck" attacked fellow crew members and U.S. marshals during a flight from Charlotte to Frankfurt, Germany, last week.

The complaint filed in U.S. District Court in Charlotte says Joanne Snow is charged with interference with flight crews and attendants, and with assaulting, resisting or impeding an officer or employee of the United States.
In an affidavit, federal air marshal Joseph Fialka says Snow's fellow flight attendants told him she was acting erratically. He said they had requested that she not work the flight, but American Airlines management didn't remove her.
Fialka says Snow slapped a flight attendant, grabbed another air marshal's collar and struck him in the chest.

Many were met with an Error message or told their carts were empty despite having added the item.
Fans took to Twitter to complain about her site being down, prompting Kylie to respond: 'Nobody be upset! There's so many people trying to buy at once so there are some tech issues.'

She added in a subsequent tweet: 'Everybody stand by and keep trying! We r [sic] working on it.'
But Kylie's tweets did little to quell her fans, who were eager to buy the Lip Kit that was two years in the making.
'I typed my credit card info and it kept saying error, stupid because the items where in my cart too... so annoyed tbh,' said one user, who went on to complain about Kylie's lack of apology for the site's problems.

'I think more should be added to say "sorry" for these "tech issues" like people like me who had the items in cart,' she added.
Many other fans said they were not purchasing because of the Lip Kit's price, which was $37 in total when combined with shipping charges.

63-year-old Marco Parma, headmaster of Garofani School in Rozano near Milan has been forced to resign after he cancelled all Christmas festivities so as not to hurt non-Christians and non-religious sensibilities. He proposed a January 21st non-religious 'winter concert' instead.
His indulgent political correctness however backfired after he came under fire from the prime minister and even Muslim parents. Italy's Prime Minister, Matteo Renzi (pictured above) who labelled the move a "big mistake" said:

"Debate and dialogue doesn't mean drowning identities in an indistinct & insipid form of political correctness. All Italians, both non-religious and Christians, will never give up Christmas.
A Muslim parent at the school, Mahmoud El Kheir - who is originally from Egypt - said: "Who are us Muslims to say what can happen at an Italian school? We are guests in this country. I hope the public understand that the decision was not made because of a request by Muslim parents".
His wife, Laila Magar, said their twins, Fatma and Yassin, took part in Christmas celebrations at the school and sang "traditional Catholic songs" with the other children.
"Why create a problem that doesn’t exist", she said.

Gabriel Omogbo of Hyattsville, Maryland, is charged with attempted first degree murder, armed robbery, first degree assault and reckless endangerment.
Police believe that the 33-year-old used the website Backpage.com to find female escorts & arranged to meet up with them.

Minister of Transportation, Rotimi Amaechi has ordered a probe into the financial activities of the Maritime Academy of Nigeria (MAN), Oron, Akwa Ibom State and N18 billion remittances to the institution by the Nigerian Maritime Administration and Safety Agency (NIMASA) in the last five years. Amaechi gave the order following allegations of financial recklessness and large scale fraud leveled against the academy’s rector, Joshua Okpo.
The academy's rector had recently approached Amaechi to accuse NIMASA of starving the institute of Funds. Amaechi immediately called for a meeting with the management of NIMASA and enquired from them why it was sitting on the subvention of MAN, Oron.
This claim was however refuted by NIMASA's acting DG, Haruna Jauro who told Amaechi that the agency had remitted over N18 billion to the academy since 2009. At the enquiry of the minister, the MAN rector, Okpo said he only took over in 2011 to which NIMASA declared that a sum of N13 billion was remitted to the institution since the rector took over. When asked what he had done with the N13 billion remitted to the academy since he took over as Rector, Okpo kept giving incoherent and inconsistent answers. This made Amaechi to immediately call for a probe.

Pope Francis, who arrived conflict-ridden Central African Republic on Sunday, November 29, on his final leg of a three-nation African tour, has urged the warring factions to lay down their weapons.
"To all those who make unjust use of the weapons of this world, I make this appeal: lay down these instruments of death!"
The country has been ravaged by sectarian violence for more than two years after longtime Christian leader Francois Bozize was ousted by rebels from the mainly Muslim Seleka force. Pope Francis opened a 'holy door' during a mass at Bangui Cathedral, marking the beginning of a Jubilee year dedicated to forgiveness and reconciliation which will be formally inaugurated on December 8.
In his address, he called for "unity, urging the people to avoid the temptation of fear of others, of the unfamiliar, of what is not part of our ethnic group, our political views or our religious denomination"
He also said he hoped the upcoming elections would allow the country to peacefully begin a new chapter.
"It is my fervent wish that the various national consultations to be held in coming weeks will enable the country to embark serenely on a new chapter of its history" he said.
The Catholic leader will meet members of the Muslim community today. He will also celebrate a huge mass at the city's 20,000-seat Barhelemy Boganda Stadium.

An Ethiopian man, Asmelash Zeferu has built a plane with tutorial videos on YouTube. 35-year-old Zeferu's childhood dream was to become a pilot but he was rejected by the Ethiopian Airlines Aviation Academy and since he couldn't realize his dream, he decided to build a plane.
"I decided to build my own aircraft if I couldn't be a pilot," he told CNN. "Then I'd be able to fly high in the sky."
For 10 years, Zeferu worked on his dream, salvaging spare parts from second-hand markets and handcrafting certain parts like the airplane’s wings. He then upgraded the 48 horsepower Volkswagen Beetle engine to 78 for his two-seater aircraft and settled for the wheelbase of a Suzuki motorcycle as his landing gear.
According to CNN, he did this with the help of some aviation experts, aircraft manuals and YouTube tutorials. He encountered some technical problems during the process. However, it didn’t deter the ambitious pilot from pursuing his goal. Five months later, he is ready to take off, again.
"My dream is to become an aerospace engineer at NASA," he told CNN. "And I will be"
